1. Acceptance of Terms
By creating an account, generating an API key, pairing a WhatsApp instance, or executing any HTTP request against our gateway servers, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to all provisions, do not access or use the platform.
2. Service Description & Nature of Gateway
WhatsAPI provides cloud-hosted session bridging technology allowing users to automate interactions via their own paired WhatsApp accounts through standard REST APIs.
3. Acceptable Use & Strict Anti-Spam Policy
WhatsAPI is engineered exclusively for legitimate business communication, transactional updates, customer support, and opted-in user engagement. You expressly agree NOT to use the platform for:
- Sending unsolicited bulk advertising or spam messages to individuals who have not provided verified consent.
- Financial fraud, phishing scams, deceptive impersonation, pyramid schemes, or unverified loan solicitations.
- Distributing malware, viruses, harmful script files, or illicit content.
- Promoting gambling, betting, illegal substances, hate speech, or harassment.
- Scraping contact data or attempting denial-of-service attacks against gateway infrastructure.
Violations of our Anti-Spam Policy will result in immediate permanent account termination without refund, and may be reported to law enforcement authorities under the Indian IT Act, 2000.
4. Compliance with WhatsApp Terms & Anti-Ban Pacing
You acknowledge that WhatsApp Inc. / Meta Platforms, Inc. enforces automated behavioral algorithms. You are responsible for maintaining a healthy sender reputation by sending relevant messages to recipients who expect to hear from you.
To protect user phone numbers, WhatsAPI enforces built-in anti-ban pacing (including randomized jitter delays between 2 to 15 seconds on broadcasts). Attempting to bypass these safety throttles voids all service warranties.
5. Subscriptions, Billing & Renewal via GenesisUPI
All premium plans are prepaid for 30 calendar days. Payment is completed securely via the official GenesisUPI Payment Gateway (genesisupi.com).
- No Forced Auto-Debits: Subscriptions do not renew automatically. You have full control over when to renew.
- Quota Expiration: Monthly API quotas reset upon manual plan renewal. Unused quotas do not roll over to subsequent billing cycles.
- Plan Upgrades: Upgrades take effect immediately upon UPI payment confirmation.
6. Account Security & API Credentials
You are solely responsible for maintaining the confidentiality of your account credentials and personal API keys (`wapi_...`). Any action taken using your API key is deemed authorized by you. If you suspect an API key compromise, you must immediately regenerate your key within the API Credentials console.
7. Limitation of Liability
To the maximum extent permitted by applicable law, GenesisWay Technology shall not be liable for any indirect, incidental, punitive, or consequential damages, loss of business profits, or temporary communication interruptions arising from upstream WhatsApp network outages, device disconnection, or third-party telecommunication failures.
8. Governing Law & Legal Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any dispute, claim, or controversy arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Patna, Bihar, India.
